As both English and Hawaiian are official languages of the State of Hawaiʻi, pursuant to Article XV, Section 4 of the Hawaiʻi State Constitution and Section 1-13 of the Hawaiʻi Revised Statutes, members of the public may testify in either language. For oral testimonies offered in ʻŌlelo Hawaiʻi, additional time as may be necessary will be allowed for the testifier to provide an English translation of their testimony.

D. Adds a new Condition E to require the Applicant to establish and implement a community-based stewardship program with a nonprofit community organization to assist with implementing visitor management measures, to be outlined in a management plan that includes the preservation and perpetuation of Native Hawaiian cultural resources and traditional and customary practices, used or conducted by established Native Hawaiian practitioners and organizations in the vicinity of the Kaʻiwa Ridge Trail. Visitor management measures must include a trail scheduling and reservation system that limits trail hours and the number of visitors at any given time, and trail closure times when access would only be available to verified Native Hawaiian cultural practitioners for specific and appropriate purposes, including the practice of hula.
E. Adds a new Condition F to provide that the community-based stewardship program must also include the implementation of strategies to:
1. Increase the presence of volunteers and staff at the trailhead to help direct vehicle and pedestrian traffic, inform visitors about appropriate places to park (such as parking at Kailua Beach Park and walking to the trailhead), advise trail users on ways to limit impacts to the surrounding residents, and enforce trail hour limitations and assist with permitted access; and
2. Implement outreach and educational efforts to notify potential hikers of the limited parking availability and encourage visitors to use TheBus to get to the trailhead, and to alert potential hikers of the lack of restrooms at the trailhead.

PROPOSED CD1 TO BILL 37 (2025) (Submitted by Councilmember Kiaʻāina) – The CD1 (OCS2025-0530/6/20/2025 11:41 AM) makes the following amendments:
A. Separates SECTION 1 of the bill into two separate bill SECTIONS, with SECTION 1 of the bill covering the bill purpose and Council findings, and SECTION 2 of the bill setting forth the amendment to the State Land Use District Boundary Map (Hale‘iwa Quadrangle). Renumbers subsequent bill SECTIONS.
B. In SECTION 1 of the bill:
1. Clarifies the purpose of the bill (but does NOT change the original purpose and intent of the bill).
2. Adds Council findings relating to the standards and criteria for the approval of a petition for a State Land Use District boundary amendment ("SLUDBA") under ROH § 23-1.6.
C. In new SECTION 2 of the bill, clarifies that the State Land Use District Boundary Map (Hale‘iwa Quadrangle) is amended by reclassifying 7.292 acres of land located within the Hale‘iwa Special District and identified as a portion of Tax Map Key 6-2-005:002 (the "Petition Area"), from the State Land Use Agricultural District to the State Land Use Urban District. Adds that the reclassification is subject to the conditions in SECTION 3 of the ordinance.
D. In renumbered SECTION 3 of the bill:
1. Amends Condition A to require Basin Project, Inc. to satisfy the requirements in HRS § 205-3.5(a)(1).
2. Amends Condition B to require Basin Project, Inc. to satisfy the requirements in HRS § 205-3.5(a)(2).

3. Removes Condition C (relating to affordable housing), Condition D (relating to traffic impact), Condition E (relating to access), Condition F (relating to wastewater), and Condition G (relating to endangered species). These conditions are not considerations for SLUDBAs under State or City law, and are more appropriately considered and addressed at a later date under other required approvals and permits, such as a zone change approval, when more project details are available.
4. Removes Condition H (relating to annual reports) because there are only two conditions of approval, both of which are already required under State law.
