CITY COUNCIL CHAMBER

Pursuant to Section 92-3.7, Hawaiʻi Revised Statutes, this meeting will be conducted as a remote meeting by interactive conference technology, with the following procedures in effect for the meeting:
The meeting will be viewable: (1) by internet live streaming through https://www.honolulucitycouncil.org/meetings; (2) by televised live broadcast on ‘Ōlelo TV Channel 54; and (3) on the monitor situated outside the Council Chamber. Viewers who experience a loss of viewing signal should try switching to another viewing option.
After the meeting, the meeting will be viewable on demand at https://www.honolulucitycouncil.org/meetings. Copies of older meeting videos may be requested by calling the City Clerk’s Office at (808) 768‑5822, charges may apply.
Some Councilmembers and presenters may be participating in the meeting by interactive conference technology from remote locations.
Remote and in-person oral testimony will be permitted on all items on the agenda when each agenda item is taken up. Each speaker may not have anyone else read their statement and is limited to a one‑minute presentation.

Persons wishing to testify in-person in the Council Chamber are requested to register by 2:30 p.m. by filling out the registration form in person outside the Council Chamber. Persons who have not registered will be given an opportunity to speak following the oral testimonies of the registered speakers.

1. RESOLUTION 24-203 – DESIGNATING DTS AS THE PRIMARY GOVERNMENTAL AUTHORITY OVER FORT STREET MALL AND UNION MALL. Requesting the City Administration to designate the Department of Transportation Services (“DTS”) as the primary governmental authority having jurisdiction over Fort Street Mall and Union Mall.

PROPOSED CD1 TO RESOLUTION 24-203 (Submitted by Councilmember Dos Santos-Tam) – The CD1 (OCS2024-0832/9/17/2024 12:21 PM) makes the following amendments:
A. Adds a third Be It Further Resolved clause urging the DPR and DTS to enter into a memorandum of agreement to facilitate the transition of the jurisdiction over the two malls.
B. Makes miscellaneous technical and nonsubstantive amendments.
2. BILL 44 (2024) – RELATING TO TRAFFIC SAFETY. Promoting public safety on roadways in the City and County of Honolulu by establishing more appropriate speed limits on certain streets. (Bill passed first reading 8/7/24)

PROPOSED CD1 TO BILL 44 (2024) (Submitted by Councilmember Kiaʻāina) – The CD1 (OCS2024-0833/9/12/2024 12:06 PM) makes the following amendments:
A. Amends bill to include speed limit of 10 miles per hour for electric bikes utilized within any public park.
B. Makes miscellaneous technical and nonsubstantive amendments.
PROPOSED CD1 TO BILL 44 (2024) (Submitted by Councilmember Dos Santos‑Tam) – The CD1 (OCS2024-0780/9/16/2024 10:58 AM) makes the following amendments:
A. In SECTION 3, amends subsection (j) to specify that the Department of Transportation Services may determine the speed limit of 20 miles per hour on any roadway bordering any school grounds during certain times, and that this provision does not apply to roads owned by the State of Hawaii.

B. In SECTION 3, adds a new subsection (k) to create a 40 miles per hour category.
C. Adds a new SECTION 4 to amend ROH Section 15-12.3 by removing obsolete references and other terms made irrelevant with the ongoing modernization of society.
D. Adds a new SECTION 5 to repeal ROH Section 15-19.34, because this section contains vehicle requirements that are no longer relevant, such as flares (liquid burning pot torches) used for illumination.
E. Adds a new SECTION 6 to amend ROH Section 15-19.39 by updating the section to account for digital screens in many modern vehicles.
F. Adds a new SECTION 7 to repeal ROH Section 15-21.9, as the need for this requirement seems to have been previously addressed by past construction activities.
G. Adds a new SECTION 8 to repeal ROH Section 15-21.14 to reflect the current state of the road and bridge conditions. Renumbers subsequent SECTIONS.
H. Makes miscellaneous technical and nonsubstantive amendments.
3. BILL 50 (2024) – RELATING TO PARADES, STREET FESTIVALS, AND OTHER ACTIVITIES. Amending existing ordinances governing parades, street festivals, and other activities, including those in Waikīkī, to reduce the strain on residents, visitors, employees, first responders, and businesses caused by the closure of main public thoroughfares; to ensure that the parades, street festivals, and other activities serve a public purpose; to protect the health and safety of the public; and to establish requirements specific to street festivals for the foregoing purposes. (Bill passed first reading 8/7/24)
