As both English and Hawaiian are official languages of the State of Hawaiʻi, pursuant to Article XV, Section 4 of the Hawaiʻi State Constitution and Section 1-13 of the Hawaiʻi Revised Statutes, members of the public may testify in either language. For oral testimonies offered in ʻŌlelo Hawaiʻi, additional time as may be necessary will be allowed for the testifier to provide an English translation of their testimony.

F. Replaces Condition B with a new Condition B that requires the Applicant to submit to the DPP revised Project plans.
1. Condition B.1 requires compliance with the maximum height limit, and provides that the Project's rooftop safety railings may not exceed the required height limit by more than 42 inches.
2. Condition B.2 requires compliance with height setback requirements, and provides that the Project's rooftop safety railings may not encroach into the required height setback.
3. Condition B.3 requires correction of the Project's floor area ratio ("FAR") calculation to include the ground floor storage and utility area, which may not exceed the maximum allowable FAR of 0.7.
4. Condition B.4 requires compliance with 11-foot rear and side yard requirements if the Project's density exceeds an FAR of 0.6. The Project's rooftop safety railings may not encroach into the required yard setback, and the Project's dwelling eaves may not encroach into the required yard setback by more than 30 inches.
5. Condition B.5 requires consolidation of the Project's separate living areas (north and south wings) on the second and third levels by adding substantial interior connections between the north and south wings on the second and third levels.
6. Condition B.6 requires a reduction in the maximum amount of the Project's impervious surface area from 75 percent to 50 percent of the Project zoning lot, so there are more pervious surfaces to absorb excess stormwater.
G. In Condition E, relating to minimizing impacts to archaeological, historic, and cultural resources:
1. Adds a new Condition E.1 to require the Applicant to submit to the DPP a copy of the State Historic Preservation Division's ("SHPD") written acceptance of the Project's Archaeological Monitoring Plan ("AMP") that meets the requirements of § 13-279-4, Hawaii Administrative Rules.

2. Adds a new Condition E.2 to provide that if any archaeological, historic, or cultural resources are discovered on the Project site, the Applicant is required to consult with SHPD to implement all mitigation protocols approved by SHPD under the AMP, or as otherwise required by SHPD. Also requires that a coordination meeting be held among the Project's archaeological consultants and construction contractors prior to the start of construction to ensure that all appropriate persons have been informed of the mitigation protocols required by SHPD. Renumbers the subsequent item in Condition E.
H. In Condition F, relating to minimizing impacts to endangered, threatened, or protected avian, marine, and terrestrial fauna that may frequent or traverse the vicinity of the Project site:
1. Amends Condition F.7, relating to pre-construction nesting surveys to minimize impacts to avian fauna that may frequent or traverse the vicinity of the Project site, as follows:
a. Clarifies that a nesting survey must be conducted prior to and during construction activities year-round (instead of requiring the survey only for construction activities occurring from March through December);
b. Adds that work may not proceed if downed seabirds are discovered in the course of the survey (in addition to any nests, eggs, or fledglings) and a 100-foot buffer must be observed around any discovered birds; and
c. Adds that prior to the commencement of any ground‑disturbing or construction activities, and upon the arrival of any new workers to the Project site, the Applicant, or their designated representative, must instruct all onsite Project workers to review seabird protection information provided online by the DLNR DOFAW at https://dlnr.hawaii.gov/wildlife/seabird-fallout-season/ or any successor website or information provided by the DLNR DOFAW.
2. Adds a new Condition F.8 to provide that if any nests, eggs, fledglings, or downed seabirds are discovered during Project construction, the protocols described under Condition F.7.c must be implemented.

I. In Condition G, relating to minimizing the spread of invasive pathogens, pests, or plants:
1. Amends Condition G.3 to add a website link to the Oʻahu Invasive Species Committee's ("OISC") print materials for invasive plants and animals targeted by the OISC.
2. Amends Condition G.5 to reference the Plant Pono website at https://plantpono.org/ as a reference for native plant species instead of Native Hawaiian Plants for Landscaping, Conservation, and Reforestation; and
3. Adds a new Condition G.6 to require the Applicant to comply with the State Department of Agriculture's Plant Quarantine Interim Rule, or any successor rule adopted by the State Department of Agriculture, that restricts the movement of coconut rhinoceros beetle host material.
J. For clarity and enhanced readability, replaces Exhibits C-1 to C-11 attached to the resolution with higher resolution versions of the original exhibits, and replaces Exhibits E, F, H, and I attached to the resolution with color versions of the original exhibits.
K. Makes miscellaneous technical and nonsubstantive amendments.

Amends Condition B to clarify that the Applicant is required to submit to the DPP a deed, easement, or other legal documentation showing the Applicant's access rights on, over, and across Tax Map Key 3-5-005:076 to access one automobile parking space on the Project site next to the swimming pool. Also clarifies that Tax Map Key 3-5-005:076 is owned by the Trustees of the Estate of Bernice Pauahi Bishop DBA Kamehameha Schools, and leased by the City and County of Honolulu.
E. In Condition C, relating to landowner acknowledgements regarding coastal hazards:
1. Amends Condition C.1 to correctly reference Tax Map Key 3‑5‑005:004 (Tax Map Key 6-6-005:035 was incorrectly referenced).
2. Amends Condition C.2 to clarify that Tax Map Key 3-5-005:004 may be adversely impacted by coastal hazards, and that the landowner agrees to assume all risk and liability for any harm to or loss of life and property due to development on zoning lot that is susceptible to coastal hazards.
F. In Condition E, relating to minimizing impacts to archaeological, historic, and cultural resources:
1. Replaces Condition E.1 with a new condition to require the Applicant to submit to the DPP a copy of the State Historic Preservation Division's ("SHPD") written acceptance of the Project's Archaeological Inventory Survey ("AIS") that meets the requirements of § 13-276-5, Hawaii Administrative Rules, and includes subsurface testing conducted by a qualified archaeologist.
2. Adds a new Condition E.2 to provide that if any archaeological, historic, or cultural resources are discovered on the Project site during the AIS, the Applicant is required to consult with SHPD to implement all mitigation protocols approved by SHPD under the AIS, or as otherwise required by SHPD. Also requires that a coordination meeting be held among the Project's archaeological consultants, the construction contractor, and applicable subcontractors to ensure that the construction contractor and applicable subcontractors have been informed of all mitigation protocols required by SHPD. Renumbers the subsequent item in Condition E.

a. Clarifies that a nesting survey must be conducted prior to and during construction activities year round (instead of requiring the survey only for construction activities occurring from March through November);
b. Adds that work may not proceed if downed seabirds are discovered in the course of the survey (in addition to any nests, eggs, or fledglings) and a 100-foot buffer must be observed around any discovered birds; and
c. Adds that prior to the commencement of any ground-disturbing or construction activities, and upon the arrival of any new workers to the Project site, the Applicant, or their designated representative, must instruct all onsite Project workers to review seabird protection information provided online by the DLNR DOFAW at https://dlnr.hawaii.gov/wildlife/seabird-fallout-season/ or any successor website or information provided by the DLNR DOFAW.
2. Adds a new Condition D.8 to provide that if any nests, eggs, fledglings, or downed seabirds are discovered during Project construction, the protocols described under Condition D.7.c must be implemented.
F. In Condition E, relating to minimizing the spread of invasive pathogens, pests, or plants:
1. Amends Condition E.3 to add a website link to the Oʻahu Invasive Species Committee's ("OISC") print materials for invasive plants and animals targeted by the OISC;
2. Adds a new Condition E.5 to provide that to the extent practicable, native plant species appropriate for the area must be used for new Project landscaping, with no use of invasive species. References the Plant Pono website at https://plantpono.org/; and

3. Adds a new Condition E.6 to require the Applicant to comply with the State Department of Agriculture's Plant Quarantine Interim Rule, or any successor rule adopted by the State Department of Agriculture, that restricts the movement of coconut rhinoceros beetle host material.

PROPOSED CD1 TO RESOLUTION 25-261 (Submitted by Councilmember Kiaʻāina) – The CD1 (OCS2025-0814/10/7/2025 3:12 PM) makes the following amendments:
A. Amends the title of the resolution to read:
"AMENDING RESOLUTION 18-245, CD1, FD1, AS AMENDED BY RESOLUTION 21-115, CD1, AND AS FURTHER AMENDED BY RESOLUTION 23-253, CD1, TO FURTHER EXTEND THE DEADLINE TO OBTAIN A DEVELOPMENT PERMIT FOR A RURAL COMMUNITY COMMERCIAL CENTER AND ASSOCIATED IMPROVEMENTS IN PŪPŪKEA, OʻAHU."

B. Adds a new sixth WHEREAS clause to provide that the Applicant is currently in negotiations for the City to purchase parcels 68, 69, and 70 (the "Parcels") for the development of a first responders' hub (the Foodland Farms parcel 16 is excluded from the negotiations), and as the negotiations continue, the Applicant has put its development activities on hold, but wishes to retain its SMA Major Permit entitlements under Resolution 18-245, CD1, FD1, as amended by Resolution 21-115, CD1, and as further amended by Resolution 23-253, CD1.
C. Amends the now seventh WHEREAS clause to clarify that the City is actively pursuing the purchase of the Parcels, as evidenced by the Council's adoption of Resolution 25-81 on April 16, 2025, which added a Government Building symbol in the vicinity of the parcels on the public infrastructure map ("PIM") for the North Shore Sustainable Communities Plan area.
D. Amends the now eighth WHEREAS clause to clarify that the addition of the PIM symbol allowed the Council to appropriate $26 million for land acquisition for the North Shore Ocean Safety Station and Ambulance Unit Facility in the City's Fiscal Year 2026 Executive Capital Budget and Program, which was enacted by Ordinance 25-39 on June 24, 2025.
E. Adds a new 11th WHEREAS clause to provide that the DPP's report indicates a two-year extension of the deadline to obtain a development permit for the Project is reasonable because the Applicant has demonstrated progress in moving forward with the Project; completed all of the requirements included in Resolution 18-245, CD1, FD1, as amended by Resolution 21-115, CD1, and as further amended by Resolution 23-253, CD1; and in lieu of pursuing an expedited development and construction schedule to meet the deadline to obtain a development permit for the Project, is continuing to negotiate in good faith with the City in the City's effort to purchase the Parcels.
F. Makes miscellaneous technical and nonsubstantive amendments.
