CITY COUNCIL CHAMBER

Pursuant to Section 92-3.7, Hawaiʻi Revised Statutes, this meeting will be conducted as a remote meeting by interactive conference technology, with the following procedures in effect for the meeting:
The meeting will be viewable: (1) by internet live streaming through https://www.honolulucitycouncil.org/meetingshttp://www.honolulucitycouncil.com/; (2) by televised live broadcast on ʻŌlelo TV Channel 54; and (3) on the monitor situated outside the Council Chamber. Viewers who experience a loss of viewing signal should try switching to another viewing option.
After the meeting, the meeting will be viewable on demand at https://www.honolulucitycouncil.org/meetings. Copies of older meeting videos may be requested by calling the City Clerk’s Office at (808) 768‑5822, charges may apply.
Some Councilmembers and presenters may be participating in the meeting by interactive conference technology from remote locations.
Remote and in-person oral testimony will be permitted on all items on the agenda when each agenda item is taken up. Each speaker may not have anyone else read their statement and is limited to a one‑minute presentation.
As both English and Hawaiian are official languages of the State of Hawaiʻi, pursuant to Article XV, Section 4 of the Hawaiʻi State Constitution and Section 1-13 of the Hawaiʻi Revised Statutes, members of the public may testify in either language. For oral testimonies offered in ʻŌlelo Hawaiʻi, additional time as may be necessary will be allowed for the testifier to provide an English translation of their testimony.

1. RESOLUTION 25-73 – AUTHORIZING THE ISSUANCE, SALE AND DELIVERY OF MULTIFAMILY HOUSING REVENUE BONDS. Authorizing the issuance, sale and delivery of multifamily housing revenue bonds in a principal amount not to exceed $30,376,937 for the purpose of making a mortgage loan to provide financing to Komohale West Loch Venture LP, a Hawai’i limited partnership, for a multifamily rental housing development; determining and prescribing certain other matters relating thereto and approving and authorizing related actions and the execution and delivery of related documents and agreements. PROPOSED CD1 TO RESOLUTION 25-73 – (Submitted by Councilmember Dos Santos-Tam) – The CD1 (OCS2025-0194/3/6/2025 2:52 PM) makes the following amendments:
A. Adds a new first WHEREAS clause, to read as follows:
"WHEREAS, Chapter 49, Hawaii Revised Statutes ("HRS"), as made applicable to the counties by HRS Sections 46-15.1 and 46-15.2 (collectively, the "Act"), authorizes the City and County of Honolulu ("City") to issue revenue bonds to provide moneys to carry out a program of making mortgage loans available to assist in developing, constructing, rehabilitating, and providing housing for persons of low and moderate income; and".
B. In the BE IT RESOLVED clause, Section 2, adds a new first sentence to read as follows:
"In accordance with Section 1.147(f)-1 of the Internal Revenue Code of 1986, the Council hereby approves of the issuance of the Bonds, as both issuer of the Bonds, and as the governmental unit having jurisdiction over the area in which the Project is located."
C. Substitutes "the Director" for the pronouns of "his or her" or "him or her" throughout the resolution.
D. Makes miscellaneous technical and nonsubstantive amendments.

2. RESOLUTION 25-74 – EXECUTION OF A GROUND LEASE WITH KOMOHALE WEST LOCH VENTURE LP. PROPOSED CD1 TO RESOLUTION 25-74 – (Submitted by Councilmember Dos Santos-Tam) – The CD1 (OCS2025-0189/3/6/2025 9:10 AM) makes the following amendments:
A. Amends the first, second, fourth, and fifteenth WHEREAS clauses to correct the reference to the Revised Ordinances of Honolulu.
B. Amends the second WHEREAS clause to specify the references to the area median income ("AMI") is for the Honolulu metropolitan area.
C. Further amends the fourth WHEREAS clause to define the West Loch Affordable Rental Housing Project as the "Project."
D. Amends the seventh WHEREAS clause to remove the reference to the authorization for the Mayor or the Mayor's designee to make minor modifications to the Development Contract.
E. Adds a new thirteenth WHEREAS clause to reference ROH Section 38‑4.1(1) regarding the conditions under which the City may lease land for a period exceeding five years in duration.
F. Labels the attachment to the resolution as "Exhibit A" to conform to the references within the resolution.
G. Makes miscellaneous technical and nonsubstantive amendments.

EXECUTIVE SESSION
If the need arises with respect to any item on this agenda, then pursuant to Hawaiʻi Revised Statutes Sections 92-4 and 92-5(a)(4), the Committee may consult in a closed meeting with its attorneys in executive session on questions and issues pertaining to the Councilʻs powers, duties, privileges, immunities and/or liabilities relating to that item.
