Pursuant to Section 92-3.7, Hawaiʻi Revised Statutes, this meeting will be conducted as a remote meeting by interactive conference technology, with the following procedures in effect for the meeting:
The meeting will be viewable: (1) by internet live streaming through https://www.honolulucitycouncil.org/meetings; (2) by televised live broadcast on ʻŌlelo TV Channel 54; and (3) on the monitor situated outside the Council Chamber. Viewers who experience a loss of viewing signal should try switching to another viewing option.
After the meeting, the meeting will be viewable on demand at https://www.honolulucitycouncil.org/meetings. Copies of older meeting videos may be requested by calling the City Clerk’s Office at (808) 768‑5822, charges may apply.
Some Councilmembers and presenters may be participating in the meeting by interactive conference technology from remote locations.
Remote and in-person oral testimony will be permitted on all items on the agenda when each agenda item is taken up. Each speaker may not have anyone else read their statement and is limited to a one‑minute presentation.
As both English and Hawaiian are official languages of the State of Hawaiʻi, pursuant to Article XV, Section 4 of the Hawaiʻi State Constitution and Section 1-13 of the Hawaiʻi Revised Statutes, members of the public may testify in either language. For oral testimonies offered in ʻŌlelo Hawaiʻi, additional time as may be necessary will be allowed for the testifier to provide an English translation of their testimony.

PROPOSED CD1 TO BILL 52 (2024) (Submitted by Councilmember Dos Santos‑Tam) – The CD1 (OCS2025-0019/1/8/2025 2:33 PM) makes the following amendments:
A. In SECTION 1 of the bill, adds to the purpose statement:
1. Detailed data from a study by the State of Hawaiʻi ("State") Department of Health concerning incidents and injuries involving electric bicycles on Oʻahu, and their financial impact; and
2 A statement that the City Council considers it necessary to protect bicycle operators and the public at large from such incidents with new safety requirements, while also acknowledging that the State Legislature plans to amend the Statewide Traffic Code in 2025 to address the issue, which may supersede requirement in this ordinance.

B. In SECTION 2 of the bill:
1. Deletes the proposed new definition of "Electric Bicycle" in ROH Section 15-2.33; and
2. Adds a new proposed definition of "Motor," defined as "[a]s used in the terms 'bicycle equipped with a motor' and 'bicycles equipped with motors,' and for the purposes of those terms only, an electric motor not exceeding 750 watts."
C. Deletes SECTION 3 of the bill and adds a new SECTION 3, which adds the following two new sections to Chapter 15, Article 18, Revised Ordinances of Honolulu 2021 ("Operation of Bicycles and Play Vehicles"):
1. A new section related to the safe driving of bicycles equipped with motors on public streets, paths, or trails, which:
(a) Prohibits the operation of bicycles equipped with motors exceeding 750 watts from being operating on "any public street, highway, alley, path, or trail";
(b) Requires bicycles equipped with motors to be operated with the bicycle's wheels facing forward and in contact with the ground, and with the operator seated with one leg on each side of the seat, with exceptions for brief instances caused by road surface or other circumstances beyond the operator's control;
(c) Prohibits an individual from operating a bicycle equipped with a motor in "an unsafe manner " or while engaging in exhibition driving on any public street, highway, alley, path, trail, or other public right-of-way, with exceptions for exhibition riding as part of a parade, tournament, or other activity permitted by the city; and
(d) Prohibits an individual from operating a bicycle equipped with a motor from:
(i) Standing or kneeling on any seat, riding on the bicycle's handlebars, or engaging in any other non‑standard riding position;
(ii) Performing a maneuver where one or more wheels are intentionally lifted from the ground; and

(iii) Engaging in any other maneuver that endangers the operator or any other person.
2. A new section related to helmet requirement for minors operating bicycles and bicycles equipped with motors, which provides that no person under 18 years of age may operate a bicycle or a bicycle equipped with a motor unless that person is wearing a helmet that:
(a) Is specifically designed for that purpose;
(b) Is equipped with a chin strap; and
(c) Meets the helmet testing and design requirements of HRS § 291C-150(a).
D. Deletes SECTIONS 4 through 6 of the bill, and renumbers subsequent SECTIONS.
E. Makes miscellaneous technical and nonsubstantive amendments.
5. BILL 61 (2024) – RELATING TO WHEELIES. Amending Chapter 15, Article 24, of the Revised Ordinances of Honolulu 2021, to address the performance of stunts or “wheelies” on public roadways. (Bill passed first reading on 12/11/24)

6. BILL 56 (2024) – RELATING TO THE USE OF MALLS. Addressing the use of pedestrian malls by amending Chapter 13, Article 10 of the Revised Ordinances of Honolulu 2021 to provide authorization to the Department of Transportation Services, instead of the Department of Parks and Recreation, to control and coordinate permitted usage of Fort Street Mall and Union Mall, and by adding a new definition of those malls. PROPOSED CD1 TO BILL 56 (2024) (Submitted by Councilmember Dos Santos‑Tam) – The CD1 (OCS2024-1075/12/18/2024 3:33 PM) makes the following amendments:
A. Inserts a new SECTION 2 to amend ROH Section 13-4.1 by amending the definition of "Enforcement officer" for purposes of litter control citation authority granted to the Department of Parks and Recreation to also include the Department of Transportation Services. Renumbers the subsequent section.
B. Amends SECTION 3 (formerly SECTION 2) of the bill to propose that the Department of Transportation Services control and coordinate permitted usage over seven "Downtown malls", extending beyond the original proposal, which included only Fort Street Mall and Union Mall.
C. Amends SECTION 4 of the bill by adding five new malls and the collective term "Downtown malls" to the definitions used in ROH Chapter 13, Article 10.
D. Relocates and amends former SECTION 3 (renumbered as SECTION 5) of the bill by amending the definition of "Department" for purposes of administrative permitting to mean the Department of Transportation Services with respect to Downtown malls in addition to Fort Street Mall and Union Mall.
E. Makes miscellaneous technical and nonsubstantive amendments.
